Khan was due to testify in July, but his hearing was postponed due to his hospitalisation following a shooting.
In his absence, the commission viewed evidence linked to Khan's WhatsApp messages.
In an application shared on Friday, evidence leaders said Khan's responses via his legal team should be held in private.
They've warned that the information may risk ongoing sensitive investigations.
The commission is due to resume on Monday.
